1. Acceptance of Terms

By accessing or using BuyerCheck (the “Platform”), available at app.buyercheck.ae, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Platform. These Terms constitute a legally binding agreement between you and Altieri Firm LLC, the owner and operator of BuyerCheck.

2. Description of Service

BuyerCheck is a Software-as-a-Service (SaaS) platform designed to assist licensed UAE real estate agents and developers in meeting their Anti-Money Laundering (AML) compliance obligations under:

• Federal Decree-Law No. 10 of 2025 on Anti-Money Laundering and Combating the Financing of Terrorism
• Cabinet Resolution No. 134 of 2025
• RERA AML requirements for licensed real estate brokers

The Platform provides instant buyer screening, Enhanced Due Diligence (EDD) report generation, and automated goAML regulatory filing support.

3. Eligibility

You must be at least 18 years old and a licensed UAE real estate professional (agent, broker, or developer) to use the Platform. By registering, you represent that you hold the necessary licences and regulatory approvals to conduct real estate transactions in the UAE.

4. Account Registration

To access the Platform, you must create an account using accurate, complete, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

5. Permitted Use

You may use the Platform solely for lawful AML compliance screening of property buyers in connection with real estate transactions in the UAE. You must not:

• Use the Platform for any purpose other than AML compliance
• Screen individuals without a legitimate real estate transaction basis
• Share, resell, or sublicense access to the Platform
• Attempt to reverse engineer, decompile, or extract screening data at scale
• Use the Platform in any manner that violates UAE law or applicable regulations

6. Compliance Responsibility

BuyerCheck provides risk intelligence and compliance tools only. The Platform does not constitute legal advice. The licensed real estate agent or developer remains solely responsible for:

• All compliance decisions made in connection with a transaction
• Verification of buyer identity documents
• Filing obligations under UAE AML law including goAML reporting
• Retaining screening records for the statutory minimum period of 7 years

A BuyerCheck screening report is advisory in nature. Final approval or rejection of a transaction rests with the registered professional.

7. Screening Credits and Payment

Access to screening features requires an active subscription or sufficient screening credits. Fees are charged in advance and are non-refundable except as required by applicable UAE consumer protection law. Overuse beyond your plan limits will result in automatic overage charges at the rate published on the Platform at the time of use.

8. Data Accuracy

Screening results are generated using third-party AML data providers. BuyerCheck does not guarantee the accuracy, completeness, or timeliness of screening results. The Platform expressly disclaims liability for any false positives, false negatives, or data errors originating from upstream data sources.

9. Intellectual Property

All content, software, algorithms, risk scoring methodologies, report templates, and trademarks on the Platform are the exclusive property of Altieri Firm LLC. You may not reproduce, distribute, or create derivative works without prior written consent.

10. Confidentiality

Enhanced Due Diligence reports and screening records generated by the Platform are strictly confidential and intended solely for the use of the authorised recipient. Unauthorised disclosure, reproduction, or distribution is prohibited and may constitute a violation of UAE data protection and AML laws.

11. Limitation of Liability

To the maximum extent permitted by UAE law, Altieri Firm LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to losses resulting from reliance on screening results, regulatory penalties, or transaction losses.

12. Indemnification

You agree to indemnify and hold harmless Altieri Firm LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your failure to comply with applicable UAE AML regulations.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct we determine in our sole discretion to be harmful to the Platform or other users. Upon termination, your right to access the Platform ceases immediately. Screening records will be retained for the statutory period.

14. Modifications

We may update these Terms at any time. Continued use of the Platform following notice of changes constitutes acceptance of the revised Terms. Material changes will be communicated by email to your registered address.

15. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
